In the brokerage business, we maintain a relationship with our clients based on confidentiality and transparency. Usually we make individual agreements for the respective business. The following principles have developed over the years:

  1. The brokerage contract between the customer and us is concluded either by written agreement or by the use of our brokerage activities on the basis of or in knowledge of the commission claim accruing for the successful brokerage/evidence activity. If nothing else arises from the circumstances or deviating agreements, the contract has a duration of 12 months and is automatically extended for another month in each case, unless one of the contracting parties has terminated the contract with one month's notice prior to the end of the contract.
  2. The customer is not entitled to assign other brokers with mediation and/or verification activities concerning the object of the contract during the term of the brokerage agreement with us. In the event of a culpable breach of this provision, the customer shall be liable to us for any damage resulting therefrom.
  3. Our brokerage and/or verification activities are carried out on the basis of the information provided to us by our contractual partners or other information providers. No liability is assumed for this. Mistakes and/or intermediate sale or renting are reserved.
  4. Insofar as there is no conflict of interests, we are entitled to charge commission for the other party to the main contract.
  5. If a rental agreement is concluded between the parties to the main contract for the object of the contract instead of the originally intended purchase agreement through our brokerage and/or proof activity or vice versa, this does not affect the claim to commission. The usual brokerage fee in the sense of § 653 para. 2 BGB (German Civil Code) shall then be deemed to be owed.
  6. If the customer knows at the time of conclusion of the brokerage contract the contractual opportunity regarding the offered object of contract as well as the readiness of the other part of the contract of the main contract (preliminary knowledge) or if he obtains this knowledge during the term of the brokerage contract from a third party, he has to inform us immediately.
  7. Our property exposés, the property/contract-related information provided by us, as well as our entire brokerage and/or verification activities, are or are exclusively intended for the respective addressed customer (s) as the recipient. The customer is obliged to handle the information confidentially after conclusion of the brokerage agreement and not to pass it on to third parties. If the customer culpably violates this, he shall be liable to us for damages if the success of our brokerage and/or verification activities does not occur as a result. If the main contract is concluded with a third party due to the unauthorized passing on of the information, the customer is liable to us for payment of the lost commission.
  8. The commission claim is due within the meaning of § 652 para. 1 BGB (German Civil Code) upon conclusion of the effective main contract if the main contract is based on our contractual proof/procurement activity. The customer is obliged to inform us immediately when, at what price and with which participants the main contract was concluded. The obligation to provide information is not affected by the fact that the main contract is subject to a condition precedent and this has not yet occurred.
  9. The customer may only assert rights of retention or set-off rights against our commission claim if the customer's claims are based on the same contractual relationship (brokerage contract) or if other claims are undisputed or legally valid.
  10. We do not participate in dispute settlement proceedings before a consumer arbitration board.
